This ITEC page has been created to aid every UST owner in maintaining compliance with EPA UST regulations (40 CFR part 280). This is also a central repository of UST compliance information for our member tribes and any others who may need such information for their facility.  As with any other source of information, this site is constantly changing and improving. Your input can only help this site improve.

If you have never had a UST inspection performed, you may have some apprehension about the inspection itself and about the inspectors. ITEC's UST compliance inspectors are trained professionals that are taught how to identify and recognize compliance violations.

You will find ITEC inspectors more than willing to go the extra mile to share their knowledge and experience in helping you solve any compliance problems you may have. They may not know every answer but they will be willing to help you contact someone who can answer your questions. You should see them as allies as their goal is the same as yours -- to help your UST systems reach and stay in compliance.

However, a thorough inspector often observes violations. If that happens, just remember that the inspector is simply doing his or her best to help you. ITEC's inspectors cannot and will not fine you for any violations. Any violation that is observed during an inspection will be kept confidential. ITEC inspectors will tell you what needs to be reported to EPA, but it will be the owner’s/operator’s responsibility to report and repair any problems. ITEC inspectors cannot give you advice on business decisions you must make, such as what brand of equipment to purchase or install, or which vendor or contractor to use.

As an owner or operator of a UST system, it is your responsibility to assure optimal operation of that system. Failure to operate a UST system safely and maintain its working parts could result in a devastating financial loss to the owner. The cost of losing your inventory is magnified by cleanup costs, which can reach up to $1,000,000.00 (one million dollars) and lead to lawsuits by impacted parties. As of the passing of the Energy Policy Act of 2005 any UST system not meeting compliance can be "Red Tagged" and denied the delivery of fuel. The closer you monitor your UST system, the less likely you will be subjected to these situations.
